Terms of Service
These Terms of Service ("Terms") govern your use of the betogether app and related services (collectively, "betogether" or "Service"). Please read them carefully. By using betogether, you accept these Terms.
betogether is a private, closed social app for tight-knit groups ("Tische"). It is not a marketplace, an advertising platform, a payment service, or a public network.
1. Provider
The provider of the Service is the entity named in the Imprint. Full contact details and representation information are available there.

2. Scope and acceptance
These Terms apply between you and the provider. By registering, first signing in, or continuing to use betogether, you agree to these Terms. If you do not agree, please do not use betogether.
The applicable version is the one in effect at the time of use. The current version date is shown at the top of this document.
3. Account requirements
To use betogether, the following applies:
- You are at least 14 years old (the digital-consent age in Austria under § 4(4) DSG). Persons under 14 may not use betogether.
- You register with a phone number or email address that belongs to you, or via "Sign in with Apple"/"Sign in with Google".
- Your profile information is truthful and up to date.
- You do not share your account with third parties and you protect your devices against unauthorized access.
- Only one account per person is permitted.
You are responsible for all activity on your account. If you suspect unauthorized access, contact us immediately.
4. Features and limits
betogether lets you share content in small groups. The following limits protect the "small circle" character of the Service:
- A maximum of 15 members per Tisch.
- A maximum of 5 Tische per user.
- Reasonable size limits for uploads (images, videos, voice notes) and text entries. Specific numbers may change for technical reasons and are visible in the app.
We may adjust these limits at any time for operational or legal reasons.
5. Acceptable use
We want betogether to be a safe place. The following is, in particular, prohibited:
- Harassment, bullying, stalking, or threats toward others.
- Hate speech and content that incites violence or degrades people based on origin, religion, sexual orientation, gender identity, or disability.
- Child sexual abuse material (CSAM) — we report such content to the competent authorities immediately.
- Identity abuse / impersonation of others.
- Spam, phishing, commercial promotion, mass invitations, or the systematic harvesting of phone numbers.
- Illegal content of any kind under Austrian, German, or Union law.
- Automated access (bots, scrapers) without our express consent.
- Circumventing security or rate-limit measures.
- Distributing malware or uploading tampered files.
Violations may lead to suspension of your account and — in case of criminal acts — to reports to law enforcement.
6. Your content and rights
You keep all rights to the content you create or upload on Tisch ("User Content"). To make Tisch work, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, cache, compress, transcode, and display your User Content solely to the members of your Tische who are intended to have access to it.
This license exists only as long and as far as it is necessary to operate the Service. As soon as you delete a piece of content or close your account, the license ends — subject to the removal of technical copies (backups, caches) within a reasonable time.
You represent that you have the necessary rights to all uploaded content and that your User Content does not infringe the rights of third parties.
7. Content from other members
Tisch is designed for private exchange in small groups. Content other members share in your Tische is not intended for redistribution to third parties. Be discreet. Screenshots, forwarding, or publication outside your Tisch may infringe personality rights.
We make no warranty as to the truthfulness, accuracy, or lawfulness of content shared by other users.
8. Spotify, contacts, push, and other optional features
Some features require your consent to third-party services or device permissions:
- Spotify: linking your Spotify account so other members can see what you are currently listening to.
- Contacts: picking people from your address book to invite to a Tisch.
- Push: notifications about activity.
These features are optional. You can enable and disable them at any time in settings.
The Spotify feature is additionally subject to Spotify's own terms of use (https://www.spotify.com/legal/end-user-agreement/). Playback control requires an active Spotify Premium subscription and the installed Spotify app; the actual playback is performed by Spotify. betogether is not a Spotify product and is not affiliated with Spotify. "Spotify", the Spotify logo, track titles, artist names, and album artwork are trademarks of, or owned by, Spotify AB and the respective rights holders. You may use content provided through Spotify solely within the scope of Spotify's terms of use.
9. Suspension and termination
9.1 Suspension by the provider
We may temporarily suspend or permanently close your account if:
- you violate these Terms,
- there is concrete evidence of illegal behavior,
- it is necessary to protect other users or the Service,
- authorities require it.
Before permanently closing an account, we will, where appropriate, try to inform you in advance. For severe violations (e.g. CSAM, imminent threats), we may act without prior notice.
9.2 Appeals
If you believe a suspension is unjustified, you can appeal:

We usually review appeals within 14 days.
9.3 Termination by you
You can delete your account at any time without giving reasons. In settings you will find "Delete account". After a 30-day grace period, your data is irreversibly removed (details in the Privacy Policy).
10. Availability
We aim to keep betogether available continuously but make no specific uptime promises. Maintenance, outages, force majeure, or third-party interference may cause interruptions. There is no claim to any specific availability.
11. Liability
11.1 General
We are liable for damages according to statutory provisions, but limited as set out below.
11.2 Unlimited liability
We are liable without limitation for intent and gross negligence, for damages from injury to life, body, or health, and under the Product Liability Act.
11.3 Limited liability
For ordinary negligence, we are only liable for breach of essential contractual obligations (so-called "cardinal duties"), and only up to the amount of typical, foreseeable damages. Any further liability — in particular for lost profits, indirect damages, or data loss — is excluded to the extent permitted by law.
11.4 Third-party content
We are not responsible for the substantive content uploaded by other users. The liability rules for service providers under ECG / DSA apply.
These liability clauses follow § 309 BGB and comparable Austrian provisions and apply to the extent permitted by law.
12. Privacy
The processing of personal data is governed by our Privacy Policy. It is part of these Terms insofar as it concerns your contractual rights and obligations.
13. Changes to these Terms
We may update these Terms when features, the legal environment, or business processes change. We will notify you of changes in the app. For material changes, we will ask you to expressly re-accept them before you continue using the Service.
If you do not accept material changes, you can terminate your account as described in Section 9.3.
14. Governing law and venue
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in the EU, the protection of mandatory provisions of the law of their country of residence remains unaffected.
The exclusive place of jurisdiction for disputes with merchants is — to the extent permitted — the provider's seat (6361 Hopfgarten, Austria).
15. Dispute resolution
The European Commission provides an online dispute resolution platform (ODR): https://ec.europa.eu/consumers/odr. We are not obliged and currently not willing to participate in dispute resolution before a consumer arbitration board.
16. Severability
Should any provision of these Terms be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid one.
